General Terms and Conditions of Sale (GTC)
Article 1 - Purpose:
These terms and conditions govern the sale by Instants Plaisirs 925 sterling silver or gold-plated jewelry and costume jewelry.
Article 2 - Price:
The prices of our products are listed in euros, including all taxes (VAT and other applicable taxes as of the date of the order), unless otherwise specified, and do not include processing and shipping fees.
Instants Plaisirs the right to change its prices at any time; however, the product will be billed based on the price in effect at the time the order is confirmed.
The products remain the property of Instants Plaisirs the price of each order has been paid in full.
If you place an order for delivery to a country other than mainland France, you are the importer of the product(s) in question.
Customs duties, local taxes, import duties, or state taxes may be applicable. These duties and fees are beyond the control of Instants Plaisirs. You are responsible for them and bear full responsibility for both filing the necessary declarations and making payments to the relevant authorities and agencies in your country. We recommend that you consult your local authorities for more information on these matters.
Obvious pricing error:
If a price displayed on the website is clearly incorrect—particularly as a result of a technical malfunction or human error— Instants Plaisirs the right to cancel the order, even after it has been confirmed and paid for.
A pricing error is considered obvious when the displayed price is significantly lower than the product’s normal price and a reasonable consumer could not have failed to recognize that it was an error.
In this case, the customer will be immediately notified of the cancellation of their order and will receive a full refund of the amount paid, without being entitled to enforce the sale.

Contractual information is provided in French and will be confirmed no later than when you confirm your order.
Special Case: If an order is canceled due to an inventory error, Instants Plaisirs offer you a replacement with a similar product or a refund for that order.
Article 4 - Confirmation of Your Order:
Any order placed on the website www.instants-plaisirs.com constitutes acceptance of these Terms and Conditions.
By confirming an order, you fully and unconditionally agree to these terms and conditions of sale, without exception or reservation.
All of the data provided and the recorded confirmation will serve as proof of the transaction.
You acknowledge that you are fully aware of this.
The order confirmation shall be deemed a signature and acceptance of the transactions carried out.
Cancellation Policy in the Event of an Obvious Pricing Error
Instants Plaisirs the right to cancel an order in the event of an obvious pricing error, as defined in Article 2—Prices. In such a situation, the customer will be notified as soon as possible and will receive a full refund of the amount paid.
Article 5 - Payment:
By confirming your order, you agree to pay the listed price within 7 days if paying by bank transfer. Taxes and shipping costs are calculated at checkout before you confirm your order.
Payment for your purchases can be made by bank transfer, PayPal, or credit card through the secure payment services provided by our service providers: PayPal, Payplug,or Mollie (Bancontact).
In addition, our online store complies with the European PSD2 3D-Secure regulations.
Installment Payments with Alma
Installment payments are available through our partner, Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Total purchase amount:
P2X: Only purchases between €50 and €2,000 are eligible for payment via Alma.
P3X: Only purchases between €50 and €2,000 are eligible for payment via Alma.
Fees
When paying in installments with Alma, the Customer does not pay any fees.
Alma is an electronic payment processor and issues an electronic certificate that shall be considered proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.
Cancellation
Any termination of the Terms of Use between the Seller and the customer will result in the termination of the Terms of Use between Alma and the customer.
Article 5 bis - Order Cancellation Before Shipment:
Any request to cancel an order before it is shipped may result in a processing fee being charged to cover the non-refundable bank fees incurred by Instants Plaisirs including commissions charged by payment service providers).
These fees are calculated at a flat rate of €1.50 for orders under €50, and at 2.9% of the total order amount for orders exceeding that amount. Details of these fees are provided to the customer at the time of cancellation.
By confirming their order, the customer acknowledges that they have read and accepted this provision.
This provision does not apply in the event that the right of withdrawal is exercised after receipt, as provided for in Article 6 of these Terms and Conditions.
Article 6 - Right of Withdrawal:
In accordance with the provisions of Article L.221-18 of the Consumer Code, you have fourteen days (14 days) to exercise your right of withdrawal, without having to provide a reason for your decision or incur any costs other than the return shipping costs.
The period mentioned above begins on the day the consumer or a third party designated by the consumer (other than the carrier) receives the goods.
In addition to the feature for exercising the right of withdrawal, Instants Plaisirs also Instants Plaisirs a form for managing returns, exchanges, and refunds, which is available at the following address:

This form can be used, among other things, to request an exchange, a refund, or a voluntary return; to report an issue with an order; or to provide additional information regarding an after-sales request.
When necessary, Instants Plaisirs ask the customer to use this form to facilitate the logistical and administrative processing of their request.
However, the use of this supplementary form does not affect the exercise of the legal right of withdrawal, which can be exercised directly through the dedicated feature available at:

This feature allows you to submit a request to cancel electronically and receive an automatic acknowledgment of receipt in a durable medium.
Although we take great care in preparing your orders, there may be instances where the order does not match what you ordered (for example, an item different from the one ordered). In such cases, you must notify Instants Plaisirs email as soon as possible, and no later than 14 days after receipt, so that we can work together to find a solution.
Returns must be made in their original condition and include all components (packaging, accessories, etc.). You are responsible for the condition of the item during return shipping. Any damage to the product during return shipping may result in the denial of your right of withdrawal.
Requests for customized products or products made to customer specifications
The cancellation feature and, where applicable, the cancellation or return requests accessible through the customer account allow the customer to submit a request to Instants Plaisirs. Submitting such a request does not constitute automatic acceptance of the request.
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal may not be exercised, in particular, for goods made to the consumer’s specifications or that are clearly personalized. This includes, in particular, engraved jewelry, jewelry personalized at the customer’s request, and special orders made according to specific instructions or specifications.
Consequently, when a request for withdrawal, cancellation, or return concerns a product subject to one of these exceptions, Instants Plaisirs the right to refuse such a request after reviewing the case and to notify the customer by any durable means.
When a customized product or one made to the customer’s specifications has already entered the manufacturing, assembly, engraving, customization, or specific preparation phase for the customer, this circumstance constitutes additional evidence of the product’s non-standard nature, although the exclusion of the right of withdrawal does not depend solely on the stage of production.
Special Case: If you wish to return an item from an order that included a free piece of jewelry offered for purchases above a certain amount, you must return that free item if the order total after the return is less than the amount required for the offer.
Special Case: If you wish to return an order that includes a free gift card offered with any purchase during a promotional period, the gift card will be deactivated and rendered unusable if the entire order is returned.
Return Procedure: You may return (at your own expense and with tracking) your items, well-protected in their original packaging, using the withdrawal form provided in Appendix 1 of this document. This form must be included in the package you use to return the product(s).

If you exercise your right of withdrawal, Instants Plaisirs refund the amounts paid within 14 days of receiving your order, using the same payment method you used when placing the order.
Return Policy: For logistical reasons, returns for orders delivered to a pickup location can only be processed via shipment to the customer’s home address. In this case, the customer must include a note with the package stating their full home address so that the items can be returned if necessary.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL:
All Products are eligible for return, except those excluded by law under Article L221-28 of the Consumer Code, such as products that have been customized at your request.
The following items cannot be returned or exchanged:
- - Earrings (or single earrings) cannot be returned or exchanged for hygiene reasons.
- - Highly personalized jewelry.
- - Special orders (produced at the customer's request based on written specifications).
Any request for a return or exchange will be processed within 14 days of receipt of the package at the address specified in Appendix 1 hereto.
Article 7 - Availability:
Our products are available as long as they are listed on the Instants Plaisirs website Instants Plaisirs while supplies last.
If a product is out of stock after you place your order, we will notify you by email within a reasonable amount of time. We will offer you the option of either a replacement with a similar product or a refund for that order.
Article 8 - Delivery:
Instants Plaisirs to shipping products to the specified delivery address within the timeframe indicated at the time of order confirmation (1 to 4 business days). This timeframe may be longer for personalized products (the timeframe is indicated on the product page and on the dedicated pages) or during promotional periods or holidays (e.g., Black Friday, Advent calendars, After-Advent calendars, Christmas).
During holiday periods, the next shipping date is displayed before the order is confirmed. Orders are then processed in chronological order starting from the date operations resume.
In the event of a shipping delay, an email will be sent to inform the customer of any potential impact on the delivery time. If this extended delivery time is not acceptable, the customer may request cancellation of their order via the contact form: https://instants-plaisirs.com/pages/contact/. A refund will be issued within 14 days.
The legal deadline for delivery is 30 days after the order is confirmed.
In the event of a delay attributable to the carrier (La Poste, Bpost, Deutsche Post, Mondial Relay, etc.), the customer may contact Instants Plaisirs via the contact form so that an investigation can be initiated with the carrier.
If there is a problem with the package upon delivery (damaged, opened, empty, etc.),the customer must file a claim with the carrier (for example, La Poste at 3631) and notify Instants Plaisirs as soon as possible.
Shipping Options:

La Poste Registered Mail: Delivered to the mailbox without a signature.

La Poste International Priority Tracked Package: Delivered to mailbox without requiring a signature.

La Poste Registered Colissimo Letter or Package: delivery upon signature or notification if the recipient is absent—full refund in accordance with La Poste’s terms and conditions in the event of loss, theft, or damage.

La Poste International Registered Parcel (Tracked): Delivery upon signature or notification if the recipient is absent—full refund subject to La Poste’s terms and conditions.

Mondial Relay: Delivery to a pickup point or locker selected by the customer. Pickup requires a valid ID or the locker code. No disputes regarding delivery will be accepted. In the event of identity theft or unauthorized access to email accounts, the customer must file a complaint with the authorities.

Colissimo with tracking, no signature required (Advent calendars / After): delivered to the mailbox without requiring a signature.

Colissimo with signature upon delivery (Advent calendars / After): delivery with signature or a notice left if the recipient is not home; full refund in accordance with La Poste’s terms and conditions.
- Chronopost 18: Delivery the day after shipment, by 6 p.m., Monday through Friday.
Instants Plaisirs change the original delivery method to delivery requiring a signature when the order value warrants it. If you are not home, a delivery notice will be left, allowing you to pick up the package at the corresponding post office.
If the address is incomplete (including cases where the name is missing from the mailbox) or incorrect, resulting in the package being returned to the sender, a fee may be charged for reshipment.
Free shipping on orders over €50 does not apply to the following products: Advent Calendar, After-Advent Calendar, and e-gift cards.
If an order that was notified but not claimed is returned to the sender (as evidenced by the delivery notification), the packaging and shipping costs may be re-billed or deducted from the refund. If an order is returned to the sender and the customer fails to respond within six months despite follow-up reminders, Instants Plaisirs dispose of the goods as it deems appropriate, without the possibility of a reshipment or refund.
Mondial Relay – How It Works and Special Provisions:
For orders shipped via Mondial Relay,the pickup location is selected after payment due to a technical limitation of the Shopify platform. The customer selects the pickup location or locker on the order confirmation page after payment.
If the customer does not select a pickup location within a reasonable time, two situations may arise:

Instants Plaisirs ship the order to the delivery address provided by the customer or to a nearby pickup location, selecting an appropriate shipping method to avoid any delays; the customer may not contest this choice or holdInstants Plaisirs liable.

Instants Plaisirs hold the order pending the selection of a pickup location to prevent a delivery error or a return to the sender. The customer may not demand a refund or compensation as a result of this delay.
The customer acknowledges that Mondial Relay may redirect the package to another pickup point or locker within the same area in the event of capacity issues, closure, logistical impossibility, or operational constraints. Such redirection does not constitute a breach of the delivery obligation and shall not give rise to any dispute or claim for compensation, provided that the package is made available at a pickup point within the same geographic area.
Delivery is considered complete once the scan confirming availability at the pickup point or locker has been recorded. In the event of identity theft during pickup or fraudulent use of the pickup code, it is the customer’s responsibility to file a complaint with the appropriate authorities.
Any delivery made to the address provided by the customer is deemed to be in compliance, even if the package is handed over to a third party present at that address.
The use of a business or commercial address that is not part of an official pickup service is the sole responsibility of the customer.
Special cases related to international shipments:
Instants Plaisirs every effort to ship orders to the specified address. However, actual delivery may depend on customs restrictions specific to the destination country. If customs refuses the shipment, no refund or reshipment may be requested. The customer must provide an alternative address in another country for a new shipment, at their own expense. Otherwise, the order will be held for six months before being considered abandoned.
Article 9 - Gift Cards:
Gift Cards: To use one, simply enter the unique code printed on your gift card when placing your order.
The gift card can be used in multiple transactions and is valid for 1 year from the date of purchase throughout our online store at www.instants-plaisirs.com (For gift cards issued since December 2019; prior to that date, the card could not be used in multiple transactions).
E-Gift Card: Sent by email within minutes of payment confirmation (if you don't see the email, please check your spam or junk folder).
Gift card / postcard: Shipped by mail within the timeframe specified when you placed your order.
Article 10 - Products:
Special Cases:
Given the technical constraints of manufacturing and design, we strive to adhere as closely as possible to the specifications provided in the product descriptions. The lengths of the various chains and bracelets may vary. The same applies to the pieces that are handmade in our workshop.
In the event of a significant discrepancy, you may return the item to us in accordance with Section 6 of these Terms; the return shipping costs will be reimbursed. We recommend that you contact us first using our form so that we can work together to find the most appropriate solution.
Since the pearls used in our products are natural, they may vary slightly in color, shape, and size.
Article 11 – Warranties:
Legal Warranty of Conformity:
According to Article L217-4 of the Consumer Code: The seller shall deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when such installation was the seller’s responsibility under the contract or was carried out under the seller’s responsibility.
The product complies with the contract in accordance with Article 217-5 of the Consumer Code:
(1) Whether it is fit for the use normally expected of similar property and, if applicable:
- If it matches the description provided by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;
- If it possesses the qualities that a buyer can reasonably expect based on public statements made by the seller, the manufacturer, or their representative, particularly in advertising or on labeling;
(2) Or if it possesses the characteristics mutually agreed upon by the parties or is suitable for any special purpose sought by the buyer, which the buyer has brought to the seller’s attention and which the seller has accepted.
When acting under the statutory warranty of conformity:
- The consumer has two years from the date of delivery of the product to take legal action;
- The consumer may choose between repair or replacement of the item, provided that the chosen option does not entail a cost that is manifestly disproportionate to the other option, taking into account the value of the item or the severity of the defect—Article L.217-9 of the Consumer Code;
- The consumer is not required to provide proof of the goods’ lack of conformity during the twenty-four (24) months following delivery of the goods. Furthermore, the statutory warranty of conformity applies regardless of any commercial warranty that may have been provided.
Warranty Against Hidden Defects:
The consumer may decide to invoke the warranty against hidden defects for products sold on Instants Plaisirs in Article 1641 of the Civil Code. In such a case, the consumer may choose between rescission of the sale or a reduction in the sale price, in accordance with Article 1644 of the Civil Code.
All our products are covered by the legal warranty of conformity as set forth in this article, provided they have been used under normal conditions and that the care instructions have been followed.
The warranty does not cover aging, wear and tear, or damage caused by excessive use of perfume or hand sanitizer, nor does it cover damage, breakage, or loss resulting from the actions of a third party, improper use, or lack of maintenance.
Instants Plaisirs liable under the warranty for hidden defects in the item sold that render it unfit for its intended use.
However, it is up to the buyer to prove the existence of the hidden defect.
Any request regarding these warranties must be submitted to customer service using the form in Appendix 2 of this document. Return shipping costs will be paid in advance by the consumer and will be reimbursed only if Instants Plaisirs held liable under the warranty.
Article 12 - Force Majeure:
Instants Plaisirs shall Instants Plaisirs be held liable for the total or partial failure to perform its obligations under this contract if such failure is attributable either to the consumer, to an unforeseeable and insurmountable act by a third party not party to the contract, or to a force majeure event.
Article 13 - Liability:
The products offered comply with current French law.
Instants Plaisirs shall Instants Plaisirs be held liable in the event of non-compliance with the laws of the country where the product is delivered. It is your responsibility to check with local authorities regarding the importation or use of the products or services you intend to order.
Furthermore, Instants Plaisirs be held liable for any damage resulting from misuse of the purchased product.
Finally, Instants Plaisirs shall Instants Plaisirs be held liable for any inconvenience or damage resulting from the use of the Internet, including, but not limited to, service interruptions, unauthorized access, or computer viruses.
Article 14 - Disputes and Governing Law:
The language of this contract is French. These terms and conditions of sale are governed by French law.
Any claim arising from a dispute between the customer and Instants Plaisirs cannot be resolved through initial contact via email or mediation must be submitted by certified mail with return receipt requested in order to be considered valid and admissible.
CONSUMER MEDIATION SERVICE: Amicable settlement of disputes between businesses and consumers in accordance with Articles L611-1 through L641-1 and R612-1 through R616-2 of the Consumer Code.
In the event of unresolved disputes between the Business and the Consumer, the consumer may file a complaint with the consumer ombudsman.
Before filing a complaint with the consumer ombudsman, the consumer must have already attempted to resolve the dispute directly with the business by submitting a written complaint or by filing a complaint in accordance with the terms of the contract entered into with the business.
Consumer mediation is a form of out-of-court dispute resolution for consumer disputes. If the conditions are met, consumer mediation will proceed according to a specific process and in accordance with applicable laws.
The procedure is free of charge for the consumer (Article R612-1 of the Consumer Code).

If no agreement has been reached with the service provider following a complaint,

No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever—even in part—any elements of the website, whether they consist of text, software, images, or audio. Any simple or hypertext link is strictly prohibited without the express written consent of Instants Plaisirs.
Article 16 - Personal Data:
Instants Plaisirs the right to collect your personal information and personal data. This information is necessary for processing your order and for improving the services and information we provide to you.
They may also be shared with companies that support these relationships, such as those responsible for providing services and fulfilling orders, for the purposes of managing, executing, processing, and paying for them.
This information and data are also retained for security purposes and to comply with legal and regulatory obligations.
