Terms and Conditions of Sale
Article 1 - Purpose:
These terms and conditions govern the sale by Instants Plaisirs 925 silver or gold-plated jewelry and costume jewelry.
Article 2 - Price:
The prices of our products are indicated in euros , inclusive of all taxes (VAT and other taxes applicable on the date of the order), unless otherwise stated, and excluding processing and shipping costs.
Instants Plaisirs the right to modify its prices at any time, however the product will be invoiced on the basis of the price in effect at the time of order confirmation.
The products remain the property of Instants Plaisirs full payment for each order has been received.
If you place an order to a country other than mainland France, you are the importer of the product(s) concerned.
Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Instants Plaisirs. They will be payable by you and are your sole responsibility, both in terms of declarations and payments to the relevant authorities and bodies in your country. We advise you to check with your local authorities about these matters.
Obvious pricing error:
In the event of a clearly erroneous price being displayed on the website, particularly as a result of a technical malfunction or human error, Instants Plaisirs the right to cancel the order, even after it has been confirmed and paid for.
A pricing error is considered obvious when the price displayed is significantly lower than the normal price of the product and a reasonable consumer could not have been unaware that it was an error.
In this case, the customer will be immediately informed of the cancellation of their order and will be refunded in full for the amount paid, without being able to claim enforcement of the sale.

Special case: In the event of an order cancellation due to a stock error, Instants Plaisirs offer you a replacement with a similar product or a refund for this order.
Article 4 - Confirmation of your order:
Any order placed on the website www.instants-plaisirs.com implies acceptance of these Terms and Conditions.
Any confirmation of an order implies your full and complete acceptance of these terms and conditions of sale, without exception or reservation.
All data provided and the recorded confirmation will serve as proof of the transaction.
You declare that you are fully aware of this.
Confirmation of the order shall constitute signature and acceptance of the transactions carried out.
Reservation of cancellation in the event of an obvious pricing error
Instants Plaisirs the right to cancel an order in the event of an obvious pricing error, as defined in Article 2 - Prices. In such a situation, the customer will be informed as soon as possible and will receive a full refund of the amount paid.
Article 5 - Payment:
By confirming your order, you agree to pay the price indicated within seven days for payments made by bank transfer. Taxes and shipping costs are calculated at checkout before your order is confirmed.
Payment for your purchases can be made by bank transfer, PayPal, or credit card using secure transactions provided by the service provider: PayPal, Payplug,or Mollie (Bancontact).
Furthermore, our online store complies with the European PSD2 3D-Secure regulation.
Installment payments with Alma
Payment in installments is available through our partner Alma. Payment security is provided by Alma and its service providers. All payments are protected by 3D Secure.
Purchase amount:
P2X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
P3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
Expenses
When paying in installments with Alma, the Customer does not pay any fees.
Alma is a remote payment manager and issues an electronic certificate that will be considered as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.
Cancellation
Any termination of the Terms of Use between the Seller and the customer will result in the termination of the Terms of Use between Alma and the customer.
Article 5 bis - Order cancellation before shipment:
Any request to cancel an order before it has been shipped may result in the deduction of processing fees corresponding to the non-refundable bank charges incurred by Instants Plaisirs in particular, commissions charged by payment providers).
These fees are assessed at a flat rate of €1.50 for orders under €50, and at 2.9% of the total order amount for orders above this amount. Details of these fees are communicated to the customer at the time of cancellation.
By confirming their order, the customer acknowledges that they have read and accepted this provision.
This provision does not apply in the event of the right of withdrawal being exercised after receipt, as provided for in Article 6 of these GTC.
Article 6 - Withdrawal:
In accordance with the provisions of Article L.221-18 of the Consumer Code, you have a period of fourteen days (14 days) to exercise your right of withdrawal, without having to justify your decision or bear any costs other than the return shipping costs.
The above-mentioned period begins on the day the goods are received by the consumer or a third party designated by the consumer, other than the carrier.
Despite the care taken when preparing your orders, it may happen that the order does not match the one you placed (e.g., a different item from the one ordered). In this case, you must notify Instants Plaisirs email as soon as possible and no later than 14 days after receipt in order to agree on a solution together.
Returns must be made in their original condition and complete (packaging, accessories, etc.). In this context, you are liable. Any damage to the product during this process may result in the right of withdrawal being denied.
Special case: If you wish to return an item from an order that included a free piece of jewelry for purchases above a certain amount, the free jewelry must be returned to us if the order amount after the return is less than the amount required for the offer.
Special case: If you wish to return an order that includes a gift card offered for any purchase during a promotional period, the gift card will be deactivated and unusable if the entire order is returned.
Return method: You may return (at your expense and with tracking) your items, well protected in their original packaging, using the withdrawal form provided in Appendix 1 of these terms and conditions. This form must be included in the package you use to return the product(s).

If you exercise your right of withdrawal, Instants Plaisirs refund the amounts paid within 14 days of receiving your order, using the same payment method used when placing the order.
Practical return procedures: For logistical reasons, returns of orders delivered to a pick-up point can only be processed by home delivery. In this case, the customer must enclose a note with the package indicating their full home address so that the items can be returned if necessary.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL:
All Products may be returned, except those excluded by law in Article L221-28 of the Consumer Code, for example products that have been customized at your request.
The following items cannot be returned or exchanged:
- - Earrings (or single earrings) cannot be returned or exchanged for hygiene reasons.
- - Clearly personalized jewelry.
- - Special orders (made at the customer's request according to written specifications).
All requests for returns or exchanges will be processed within 14 days of receipt of the package at the address indicated in Appendix 1 hereto.
Article 7 - Availability:
Our products are available as long as they are visible on the Instants Plaisirs website Instants Plaisirs while stocks last.
If a product is unavailable after you have placed your order, we will notify you by email within a reasonable time. We will offer you the choice of a replacement with a similar product or a refund for your order.
Article 8 - Delivery:
Instants Plaisirs to ship products to the delivery address indicated and within the time frame specified when the order is confirmed (1 to 4 business days). This timeframe may be longer in the case of a personalized product (timeframe indicated on the product page and in the dedicated pages) or during promotional periods or holidays (examples: Black Friday, Advent Calendars, After Calendars, Christmas).
During holiday periods, the next shipping date is indicated before the order is confirmed. Orders are then processed in chronological order from the date of resumption.
In the event of a shipping delay, an email will be sent to inform the customer of any potential impact on the delivery time. If this exceptional delay is not acceptable, the customer may request cancellation of their order via the contact form: https://instants-plaisirs.com/pages/contact/. The refund will be processed within 14 days.
The legal delivery deadline is 30 days after order confirmation.
In the event of a delay attributable to the carrier (La Poste, Bpost, Deutsch Post, Mondial Relay, etc.), the customer may contact Instants Plaisirs via the contact form so that an investigation can be opened with the carrier.
In the event of any anomaly upon receipt of the package (damaged, opened, empty, etc.),the customer must file a claim with the carrier (e.g., La Poste at 3631) and inform Instants Plaisirs as soon as possible.
Delivery options:

Tracked letter via La Poste: deposited in mailbox without signature.

International priority tracked package via La Poste: delivery to mailbox without signature.

Registered letter or Colissimo parcel via La Poste: delivery against signature or notification in case of absence - full refund according to La Poste's terms and conditions in case of loss/theft/damage.

La Poste international registered parcel with tracking: delivery against signature or notification in case of absence - full refund according to La Poste's terms and conditions.

Mondial Relay: delivery to a pickup point or locker chosen by the customer. Delivery requires proof of identity or the locker code. No delivery disputes will be accepted. In the event of identity theft or fraudulent access to emails, the customer must file a complaint with the authorities.

Colissimo tracked without signature (Advent calendars / After): delivery to mailbox without signature.

Colissimo with signature upon delivery (Advent calendars / After): signature upon delivery or notification in case of absence; full refund according to La Poste conditions.
- Chronopost 18: Delivery the day after shipment before 6 p.m. Monday through Friday.
Instants Plaisirs modify the initial delivery method by opting for delivery against signature when the value of the order justifies it. In case of absence, a delivery notice will allow the package to be collected from the corresponding post office counter.
In the event of an incomplete address (including a missing name on the mailbox) or an incorrect address resulting in the return of the item to the sender, a new shipment may be charged.
Free shipping on orders over €50 does not apply to the following products: Advent Calendar, After Calendar, E-gift card.
In the event of a return shipment of an order that has been notified but not claimed (proof via delivery notification), packaging and delivery costs may be re-invoiced or deducted from the refund. In the event of a return to sender and no response from the customer for six months despite reminders, Instants Plaisirs dispose of the goods as it sees fit, without any further shipment or refund possible.
Mondial Relay – operation and special provisions:
For orders shipped via Mondial Relay,the pickup point is selected after payment due to a technical constraint on the Shopify platform. The customer selects the pickup point or locker on the order confirmation page after payment.
If the customer does not select a pickup point within a reasonable period of time, two situations may arise:

Instants Plaisirs ship to the delivery address specified by the customer or to a nearby pickup point, choosing an appropriate shipping method to avoid any delays, without the customer being able to contest this choice or holdInstants Plaisirs liable.

Instants Plaisirs hold the order pending selection of the pickup point in order to avoid delivery errors or returns to sender. The customer may not demand a refund or compensation due to this delay.
The customer acknowledges that Mondial Relay may redirect the parcel to another pick-up point or locker in the same area in the event of saturation, closure, logistical impossibility, or operational constraints. This redirection does not constitute a breach of the delivery obligation and cannot give rise to any dispute or compensation as long as the parcel is made available at a pick-up point in the same geographical area.
Delivery is considered complete once the scan confirming availability has been recorded at the pickup point or locker. In the event of identity theft during pickup or fraudulent use of the pickup code, it is the customer's responsibility to file a complaint with the relevant authorities.
Any delivery made to the address specified by the customer shall be deemed to be in compliance, even if delivered to a third party present at that address.
The use of a professional or business address that is not an official parcel collection service is the sole responsibility of the customer.
Special cases related to international deliveries:
Instants Plaisirs every effort to ship orders to the address provided. However, actual delivery may depend on customs restrictions specific to the destination country. If the goods are refused by customs, no refund or return can be requested. The customer must provide an alternative address in another country for a new shipment, at their own expense. Failing this, the order will be kept for six months before being considered abandoned.
Article 9 - Gift cards:
Gift cards: To use your gift card, simply enter the unique code printed on your gift card when placing your order.
The gift card can be used multiple times and is valid for one year from the date of purchase on our entire online store www.instants-plaisirs.com (For gift cards purchased since December 2019; prior to this date, multiple uses are not possible).
E-Gift card: Sent by email within minutes of payment confirmation (if you do not see the email, please check your spam/junk folder).
Gift card/postcard: Sent by mail within the time frame indicated when placing your order.
Article 10 - Products:
Special cases:
Given the technical constraints of manufacturing and design, we strive to adhere as closely as possible to the specifications provided in the product descriptions. The lengths of the various chains and bracelets may vary. The same applies to the designs, which are handmade in our workshop.
In the event of a major difference, you may return the item to us in accordance with Article 6 of these terms and conditions, and the return shipping costs will be refunded. We recommend that you contact us in advance using our form so that we can work together to find the most suitable solution.
As the pearls used in our products are natural, they may vary slightly in color, shape, and size.
Article 11 – Warranties:
Legal guarantee of conformity:
According to Article L217-4 of the Consumer Code: The seller shall deliver goods that comply with the contract and shall be liable for any lack of conformity existing at the time of delivery. The seller shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions, or the installation when the latter has been made its responsibility by the contract or has been carried out under its responsibility.
The product complies with the contract in accordance with Article 217-5 of the Consumer Code:
1° If it is fit for the purpose usually expected of a similar item and, where applicable:
- If it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- If it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the manufacturer, or their representative, particularly in advertising or labeling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.
When acting as a legal guarantee of conformity:
- The consumer has two years from the date of delivery of the product to take action;
- The consumer may choose between repair or replacement of the goods, provided that their choice does not entail a cost that is clearly disproportionate to the other option, taking into account the value of the goods or the significance of the defect – Article L.217-9 of the Consumer Code;
- The consumer is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four (24) months following delivery of the goods. In addition, the legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
Warranty against hidden defects:
The consumer may decide to enforce the warranty against hidden defects in products sold on Instants Plaisirs meaning of Article 1641 of the Civil Code. In this case, the consumer may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.
All our products are covered by the legal guarantee of conformity as set out in this article, provided that they have been used normally and that the maintenance instructions have been followed.
The warranty does not cover aging, wear and tear, or damage caused by excessive use of perfume or hand sanitizer, nor does it cover damage, breakage, or loss resulting from third-party intervention, improper use, or lack of maintenance.
Instants Plaisirs bound by the warranty against hidden defects in the item sold that render it unfit for its intended use.
However, it is up to the buyer to provide proof of the existence of the hidden defect.
Any request relating to these warranties must be addressed to customer service using the form in Appendix 2 of this document. Return shipping costs will be borne by the consumer and will only be reimbursed if Instants Plaisirs liable under the warranty.
Article 12 - Force majeure:
Instants Plaisirs be held liable for the total or partial non-performance of its obligations under this contract if the poor performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable actions of a third party to the contract, or to a case of force majeure.
Article 13 - Liability:
The products offered comply with current French legislation.
Instants Plaisirs be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities regarding the possibilities of importing or using the products or services you intend to order.
Furthermore, Instants Plaisirs be held liable for any damage resulting from misuse of the purchased product.
Finally, Instants Plaisirs be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusion, or the presence of computer viruses.
Article 14 - Disputes and applicable law:
The language of this contract is French. These terms and conditions of sale are subject to French law.
Any request relating to a dispute between the customer and Instants Plaisirs cannot be resolved through initial contact by email or mediation must be sent by registered mail with acknowledgment of receipt in order to be considered legitimate and admissible.
CONSUMER MEDIATION SERVICE: Amicable settlement of disputes between professionals and consumers in accordance with Articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Consumer Code.
In the event of unresolved disputes between the Professional and the Consumer, the consumer may refer the matter to the consumer mediator.
Before referring the matter to the consumer mediator, the consumer must have already attempted to resolve the dispute directly with the professional by means of a written complaint or by making a complaint in accordance with the terms of the contract concluded with the professional.
Consumer mediation is an out-of-court settlement of consumer disputes. If the conditions are met, consumer mediation will take place according to a specific process and in accordance with the applicable laws.
The procedure is free of charge for consumers (R612-1 of the Consumer Code).

Any simple or hypertext link is strictly prohibited without the express written consent of Instants Plaisirs.
Article 16 - Personal data:
Instants Plaisirs the right to collect personal information and data about you. This information is necessary for managing your order and improving the services and information we send you.
They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.
This information and data is also stored for security purposes, in order to comply with legal and regulatory obligations.
